I fully concur with the analysis and decision made by the Board
in the April
14,
1977 Opinion by Mr.
Zeitlin.
I disagree,
however,,
with the Board’s determination not to review our decision in Sherwin
Williams Company v
EPA, December
18,
1975.
Although abstaining
in
that specific case,
I disagree with the Board’s legal conclusion
in
Sherwin Williams and feel that the time is ripe for the Board to re-
consider its position concerning the applicability of Rule 205(g) (1)
(c),
i.e.
the waste gas stream from any petroleum or petrochemical
manufacturing process, to an operation which utilizes petrochemicals
as feedstock.
