ORDER OF THE BOARD
 (by Mr. Dumelle):
The Complaint in this case alleges that Respondent
violated Rule 102 and 206 of the Noise Pollution Control
Regulations through the emission of impulsive sound caused
by use of a tennis practice board located in
 a District
park.
 A hearing was held on May
 7,
 1979
 in Chicago.
According to an agreement reached between the parties
at hearing, no evidence was adduced and none was
 to be
adduced.
 The Board can make no finding of violations of
Rules
 102 and 206 in light of the lack of evidence.
 This
matter is hereby dismissed without prejudice.
