CONCURRING OPINION (by J.
Anderson):
I do feel
it is an unwise precedent to fail
to impose even
a small penalty for these violations, especially when an admitted
violation results
from failure to timely control unauthorized
disposals.
The purposes of the Act would have been better
served by imposition of at least a nominal penalty, although
Caterpillar’s past record of corporate response provides assurance
that it will fully comply with this Order.
