On January

the
City
of Mount Olive
filed a petition
for variance which is deficient
in several respects:
the recjw~sted
relief is not specified,
the costs of compliance alternatives
are not given, and the reason for restricted status
is lacking
as are any measures proposed.to minimize the adverse effects
of non—compliance.
Unless the City files an amended petition
within 45 days of the date of this Order,
this petition will
be
subject to dismissal.
Also,
the owner of the six—unit apartment complex at issue
here is ordered to be joined as a party and the City is ordered
to complete service.of process upon him pursuant to Section 103.123
of the Procedural Rules.
Finally,
the Board notes that the affidavit accompanying
the
petition,
or a second affidavit, should attest to the truth
of the material allegations
in
the
attached Exhibit
A.
