    On March 30, 1983 the Norris City Sanitary District and
    Lamplight Manor Apartment Complex filed
    a petition for variance
    from,
    apparently, the Board’s October 14,
    1982 Order in a related
    matter
    (PCB 81—187).
    That petition is deficient in that it
    purports to waive hearing but fails to include an affidavit in
    support of the material facts alleged as required by 35
    Ill.
    Adm. Code 104.124.
    Further, the relief requested is “that the
    construction of the twenty unit apartment complex be allowed
    to begin.”
    However,
    in the October 14,
    1982 Order these same
    petitioners were granted varianc~eto allow such construction to
    begin although it precluded connection until the Norris City
    sewage treatment plant had been upgraded.
    Therefore,
    the Board
    is uncertain as to what relief is requested.
    Unless an amended petition is filed curing the above—noted
    defects within
    45 days of the date of this Order, the petition
    will be subject to dismissal.
