certain respects.
The petition does not
describe the “arbitrary
or unreasonable hardship”,
either financial
or otherwise, which
the Town anticipates
if variance
is
denied.
Information as to
the next time Mr. Murphy could take the Class
I operator’s
exam
in the event he fails to pass the February,
1984 exam would be
helpful.
Finally, while hearing is waived, the petition fails
to contain an affidavit attesting to the truth of the facts
alleged,
as required by 35

If an amended petition curing these deficiencies is not
filed within 45
days
of the date of this
Order,
this
petition
will
be subject to
dismissal.
