OPINION AND ORDER OF THE BOARD

Petitioner filed a Petition for Variance from Rule 404(f)
of Chapter
3: Water Pollution on December 29,
1976.
An
Amended
Petition was filed February 22, 1977 which stipulated into the
record of
this proceeding the records of the prior variances,
namely~PCB 72—246
(May 31,
1973); PCB 74—81
(June 20, 1974);
and PCB 75—164
(July 10,
1976).
A recommendation was filed by the Illinois Environmental
Protection Agency on April
4,
1977.
No public hearing was held.
The Petitioner,
located
in Godfrey, operates a sewage
treatment plant designed
to serve a population equivalent of
750,
A load of only 500
is connected.
Discharge is to an
unnamed
intermittent stream which runs for about
0.6 miles
until
its confluence with Rocky Fork Creek.
The
College intends
to discontinue its sewage treatment
plant by connecting
to the Godfrey Township Utility Board’s
new plant.
This new facility will be operational by September 1,
1977.
An examination of the effluent from the present sewage
plant shows generally good adherence to the monthly limits of
20 mg/i BUD5 and
25 mg/i suspended solids set in PCB 75—164.
Eleven months of data (January 1976 through November 1976
inclusive)
show two months in which BOD5 levels were 26 and
27 mg/i and
two other months in which suspended solids levels
were 27 and
29 mg/i.

We agree with
the
Agency that the Petitioner has shown
good faith
in its
efforts
to reach full
compliance.
The
variance
is granted until September
1,
1977.
This Opinion constitutes
the Board’s findings of
fact and
conclusions of
law.
ORDER
A variance from Rule 404(f)
of Chapter
3: Water Pollution
is granted until September
1,
1977 subject
to the
following
conditions:
1.
The effluent from the Petitioner’s sewage treatment
plant shall not exceed
20 mg/i BUD5 and
25 mg/i suspended
solids ona monthly average.
2.
The effluent
shall
not exceed 400 fecal coliform
per
100 ml.
3,
The connected waste load to the plant
shall not
exceed its design capacity.
4.
The proposed interceptor line shall be constructed
so that
it
is ready for use when the new Godfrey sewage
plant goes into operation.
