INTERIM ORDER OF THE BOARD

On August 26, 1981 Vickery Manor Service Corporation
(Vickery) filed a request that decision in this matter be stayed
pending resolution of ‘~theissues underlying the Variance Petition
PCB 81—122,” a variance request concerning the same facility
which is at issue in this enforcement action.
The Board has
neither formally ruled upon that motion, nor decided the case.
On September 13,
1982 Vickery submitted a waiver of the
decision period in PCB 81—122.
In its notice of waiver Vickery
points out that it has filed an application with the Illinois
Commerce Commission
(ICC)
for the cancellation of its Certi-
ficate of Convenience and Necessity and for authority to abandon
its sanitary sewer service area, due to lack of funds for
maintenance and improvement of its plant and to allow for
its sale.
The Board hereby orders that within 30 days of the date
of this Order the parties shall either file
a proposal for
settlement or report to the Board regarding the present status
of this case,
including any relevant developments in PCB 81-122,
the status of the ICC hearings and settlement negotiations,
and recommendations as to the expeditious resolution of this matter.
