    Petitioner,
    v.

    PCB 82—17
    ILLINOIS ENVIRONMENTAL PROTECTION AGENCY,
    )
    Respondent.
    ORDER OF THE BOARD
    (by J.
    Anderson):
    On June
    24,
1982 the Village moved the Board to reconsider
its Opinion and Order of May 13,
    1982 granting variance from the
15 pCi/l gross alpha particle activity limitation of Rule
    304(c)(1)(b)
    of Chapter 6:
    Public Water Supply until June
    1,
    1983.
The motion was accompanied by a June 3,
    1982 analysis of one water
sample taken from the Village’s s~pplyon May
    19, 1982.
    This
analysis, performed by Hazelton Environmental Sciences,
    showed a
gross alpha particle activity level o~5.8 ±2.9 pCi/I.
    Based on
    this sample,
    as well
as the other samples indicating compliance
previously noted in the Opinion, the Village believes its water
    supply to be in compliance.
    On July
12, 1982 the Agency filed Comments in response.
    The
Agency reports that it had split the May
    19 sample with Hazelton,
and had also performed its own analysis.
    The Agency’s test showed
    a gross alpha level of 132 ±3.38 pCi/i.
    However,
    the Agency does
not dispute the accuracy of either Hazelton’s or its own result.
The additional evidence submitted by the Village does not
persuade the Board to reconsider its finding that variance relief
is necessary, as the composite of the April,
    1980 through June,
    1981 quarterly samples
is evidence of non-compliance with the
    standard
    (Op. p.
    2).
While this evi4ence could be refuted by a
    subsequent composite,
as the Agency points out, only three of the
needed 1981-1982 quarterly samples have been taken, and only two
    of these have been analyzed.
    The motion to reconsider
    is denied.
    In response to the
    Village’s alternative request,
the Board will extend the time
period in which the Village must determine whether to accept
    or reject this variance.
A certificate of acceptance shall be
filed with the Agency on or before October
    1,
    1982.
    IT
    IS SO ORDERED.
    I, Christan L,
Moffett, Clerk of the Illinois Pollution
Control Board, hereby certify that the above Order was adopted
