limitation

in its Agency permit.

The limitation pertains

to

the

nature of the lots

which

Petitioner

may

connect to

the Prestwick

Utilities sanitary sewer system.

The Petitioner does not state

whether or not this permit limitation can be changed by

a request

to the Agency for a modification of the subject permit.

Consequent-

ly this matter is hereby dismissed.

If the Agency denies Petition-

er’s request, Petitioner can file either

a permit denial appeal or

a variance petition before the Board.
