On September 28,

1981,

Oak Grove Mobile Home Park (Oak

Grove) filed a petition for variance from Rules 203(f),

404(a)

and

Cc), and 405 of Chapter

3:

Water Pollution.

The petition

purports

to waive hearing but fails to include an affidavit

attesting to the truth of the facts alleged as required by

Procedural Rule 401(b).

Further, the Board finds that the

City of Milan is necessary for a complete determination of

this action and that it must be joined pursuant to Procedural

Rules 309

and

305.

Unless, within 45 days of the date of this Order, Oak

Grove files an amended petition curing these defects, this

petition will be subject to dismissal.
