    this case based upon the exemption stated in Rule 103(i)

    Board’s Air Pollution Control Regulations.
    The motion is
    not timely under Procedural Rule 308(a), and it addresses a
    factual controversy which should be addressed in a hearing.
    Consequently, the motion is hereby denied.
