    OPINION AND ORDER OF THE BOARD

    the
    Illinois Environmental Protection
    Agency (Agency)
    filed a Recommendation that the Village of
    Franklin Grove (Franklin Grove) be granted a provisional variance
    from the biochemical oxygen demand limitations and suspended solids
    of Rule 404(c)
    (BOD/TSS) and the fecal coliforrn limitation of
    Rule 405, as contained
    in
    Chapter
    3:
    Water Pollution.
    Variance
    is requested from the BOD/TSS limits a period of time necessary
    to repaint the Franklin Grove Water Treatment Plant’s tertiary
    high rate sand filter~ Since effluent from these sand filters
    is needed to operate
    the
    chlorinator, variance from the fecal
    coliform limit is needed for the same time period.
    The Agency
    has concluded that environmental harm during the repair period
    to the downstream waters of the Franklin Creek or the Rock River
    should be minimal,
    Pursuant to Section 35(b) of the Environmental
    Protection Act the Board
    will grant this provisional variance, as
    recommended.
    ORDER
    The Board hereby grants the Village of Franklin Grove
    (Franklin Grove)
    a provisional variance from the Rule 404(c)
    limitation for biochemical oxygen demand and suspended solids
    and the Rule 405 limitation for fecal coliform for a period of
    forty—five
    (45) days beginning the day the tertiary high rate
    san~filtersare taken out of service, subject to the following
    conditions:
    1)
    Franklin Grov&s discharge shall not exceed 30 mg/i
    BOD,
    30 mg/i TSS.
    2)
    Franlkin Grove shall
    report, on DMRS,
    levels of BOD
    and TSS according to the same sample type and frequency as
    required in Petitioner’s expired NPDES Permit.

    3)
    Franklin Grove shall report to the Agency when the sand
    filters are taken out of service and when they are returned to
    service.
    Notification shall be made within
    3 days to the following

    Franklin Grove shall provide, at minimum, primary and
    secondary treatment.
    5)
    Franklin Grove shall rpovide the best degree of operation
    and maintenance that is feasible.

    Within ten days of the date of this Order,
    Franklin
    Grove shall execute a certificate of acceptance and agreement in
    the following
    form:
