)
PCB 75—267
TERMINAL RAILROAD ASSOCIATION OF
ST. LOUIS, a Missouri corporation,
Respondent.
INTERIM ORDER OF THE BOARD
(by Mr.
Zeitlin):
A hearing was held in this matter on February
19,
1976, and a
Stipulation and Proposed Settlement
(Stipulation) entered at that
hearing by the parties was filed with the Board on June
21,
1976.
The Stipulation
(at
IMI
12, 13) indicates that Respondent was
to have
installed sound barriers with noise-attenuating materials
around
certain equipment.
Paragraph
2
of the Proposed Settlement indicates
that this was to have been accomplished by May
1,
1976.
In light of uncertainties in the Stipulation on the subject
of compliance,
it should be amended to reflect whether the proposed
sound barriers have in fact been installed, and whether they have
been successful in achieving compliance with the applicable Regulations.
Leave is accordingly granted, on our own Motion, for the parties
to
amend the Stipulation and Proposed Settlement
in this matter in
conformity with the foregoing Interim Order or, as might otherwise
be indicated by any changed circumstances, within forty-five
(45)
days of the date of this Interim Order.
IT IS SO ORDERED.
I, Christan
L. Noffett, Clerk of the Illinois Pollution
Control Board
