    ORDER OF THE BOARD
    (by Dr. Satchell):
    In a letter received September 7,
    1979 Petitioner Sahara Coal
    Company, Inc.,
    requested that the Board take no action on its
    variance petition until such time as it might present additional
    information.
    The Board construes this letter as a motion for
    leave to amend and a waiver of Petitioner’s right under §38 of
    the Environmental Protection Act to a decision within ninety
    days after filing of the petition.
    Petitioner
    is granted leave to file an amended variance
    petition within forty—five days of the date of this Order.
    The
    ninety day decision period will commence from the date such
    amendment is filed.
