ORDER
OF
THE
BOARD
(by
B.
Forcade):
On August
6,
1984,
South Palos
filed a motion to extend time
for compliance
with
paragraph
4 of the
Board~sMay
29, 1984,
Order.
That paragraph required
South
Palos
to submit
a plan
or
program for identification and
elimination
of
excessive
sewer
flows to this Board not later
than August 27,
1984.
South Palos
requests
that the plan submission
date be extended by 90 days.
South Palos argues that final corrective action to eliminate
excess flows by September,
1985,
as anticipated by the Board~s
Order,
cannot
reasonably
be
achieved due to wet weather
conditions during
certain
months.
On August
9,
Cupp objected to
the
extension
of
time,
South
Palos’
motion
provided
arguments
concerning
the
final
complIance
date
of
September,
1985.
No
reasons
have
been
advanced
for
extending
the
plan
submission
date
of
August,
1984.
The
Board
will
extend
the
plan
submission
date
until
September
18,
1984.
Any
arguments
and
supporting
data
for
a
different
compliance
date,
other
than September,
1984,
may
be
addressed
in
that
plan.
After review
by
complainant
and
the
Agency,
the
Board
will
determine
whether
any
extension
of
the
date
for
ultimate
compliance is necessary and
justified.
The
date
for
submission of
the
districtwide
plan
or
program,
conta:Lned
in
paragraph
4 of the
Board~s May
29,
1984,
Order
is
hereby
extended
to
require
submission
not
later
than
September
18,
1984.
IT
IS
SO
ORDERED.
