ORDER OF THE BOARD
(by Mr. Dumelle):
It
is the Order of
the Pollution Control Board that:
1.
The Board has jurisdiction to rule on the merits
of this
matter.
2.
The Board hereby reconsiders its prior unconditional
concurrence
in the issuance
of this permit.
3.
The Board hereby concurs
in the issuance of this permit on
the following conditions:
a)
Dredging shall
be by clamshell.
b)
There shall
be no dewatering
of or intentional spillage
from the bucket except for disposal into watertight
containers.
c)
Ultimate disposal from the watertight containers
shall
be
in a facility which has received all necessary State
and/or Federal permits.
d)
A silt curtain/oil boom shall be installed around the
dredging site before dredging occurs and shall remain
in place while dredging occurs.
e)
Any oils contained by the boom shall be collected and
disposed consistent with conditions b and c.
f)
The dredging equipment and ~.zatertightcontainers
shall
be cleaned and the residues disposed consistent with
conditions b and
c.
g)
The dredging and disposal
shall be completed within one
year of the date of this Order.
h)
The Illinois Environmental Protection Agency and all
other interested governmental agencies shall
be allowed
to enter,
inspect, and monitor the dredging operations
and to take samples
of any discharge or emission of
pollutants.

4.
The Chairman is authorized
to sign the permits
as long as
it contains the conditions
in paragraph
3 of this Order.
