KROHN DEVELOPMENT CORPORATION,
Petitioner,

PCB 83—121
ILLINOIS ENVIRONMENTAL

PROTECTION AGENCY,
Respondent.
ORDER
OF
THE BOARD
(by
3.
D,
Dumelle):
On
September
22,
1983 Krohn Development Corporation (Krohn)
filed a waiver of the decision deadline in this matter until
November
22,
1983 which was the date by which a decision was due
in any case.
In response to a telephone inquiry by the Clerk
of the Board,
a second waiver, which did not waive to
a date
certain and must be considered an open waiver,
was filed on
September 29, 1983.
On November 17, 1983 a third waiver was
filed purporting
to waive decision only until March 22, 1984,
stating that ~it has come to our attention that the
September
29
waiver letter
.
,
.did not contain a date for termination
of
the waiver,
The Board will not give effect to the waiver
to
March
22,
1984.
However,
since the waiver implicitly suggests
that a decision is desired by March
22,
1984, the Board will make
every effort to decide the case by that date
if the complete
record is before the Board in a timely fashion.
IT
IS SO ORDERED.
Board Member John Marlin abstained.
I, Christan L.
