On August
15,
1984 the Agency filed a Motion directed to the
Board for leave to file addendum to ~he record,
said addendum
being a summary dated August 10,
1984 of various information
contained
in the previously filed record,
Waste Management filed
its response in
opposition
August
17, characterizing the motion
as an attempt ~to place trial exhibits into the record.~ The
Board concurs.
The Agency~smotion is denied,
and the hearing
off
icer~scontrary ruling of August 20
is overruled.
This ruling
does not, however, preclude the Agency from attempting
to intro-
duce this material
into the
record at hearing.
Decision in this matter
is
presently due September 19,
hearing being scheduled for August
27,
In order to allow the
Board time to review the voluminous record in this matter,
the
Board orders that the record
will close at 5:00
p.m.
on Monday,
September 10 at
which time hearing
transcripts, any
exhibits,
and any post—hearing submittals must be on file in the Board~s
Chicago Office,
Notwithstanding, the Board orders petitioner to
provide the Board with next-day transcripts.
One copy of the
transcript and any post-hearing submittals shall be sent by the
party making the filing directly to Board Member Marlin at the
Board~sUrbana office
(104 W. University Ave., Urbana,
IL 61801)
by any means which will insure overnight delivery.
The hearing officer shall have authority to extend this
cut-off date if,
and only
if,
the decision deadline is waived,
and any extended
cut-off date provides
the Board a full nine day
review period before the date decision
is due,
