    OPINION
    AND
    ORDER OF THE BOARD
    (by Mr. Goodman):
    This matter comes before the Board upon the petition
    filed by Granite City Steel Corp.,
    a division of National
    Steel
    (Granite City)
    on May
    4,
    1979.
    The petition seeks
    a
    variance from a Board Order entered in PCB 76—124 on September
    15,
    1976 and modified by a Board Order entered on May 12,
    1977.
    No hearing has been held in this matter and the Board has
    received
    rio public comments.
    The May 12, 1977 Order directs Granite City to shut down
    its “B” Battery, which contains twenty—seven
    (27) coke ovens,
    for the purpose of rebuilding by December 11, 1979.
    “A” Battery,
    which contains
    forty—nine
    (49) coke ovens, was to be similarly
    shut down by June 11,
    1980.
    Granite City now seeks to revise
    the above described program due
    to the unanticipated shutdown
    of
    “A” Battery
    for repair on February
    8,
    1979.
    Granite City
    requests that the date on which “A” Battery
    is shut down for
    rebuilding be recognized as February
    8,
    1979 and that the shut-
    down date for “B” Battery be extended until June
    11,
    1980.
    The petition
    is based on the premises that
    “B” Battery is in
    better operating condition that
    “A” Battery,
    that
    “A” Battery
    has been shut down ten
    (10) months prior
    to the shutdown date
    for either oven, and that not more than 137 ovens will be in
    operation at any one time
    if this variance is granted.
    In its
    recommendation, the Agency states its belief that the switch
    of
    closedown dates will not significantly affect the air quality
    in the area and recommends
    that the variance be granted
    (Rec.,
    p.2).
    The
    Board
    finds that the net result of the proposed change
    i.s roughly equivalent
    to that of the original Order.
    The
    final proposod date for shutdown of all batteries concerned
    is the same

    entered on May 12,
    1977.
    Considering that
    “A” Battery had to
    be shut down for unanticipated repairs and that
    “B” Battery is
    generally in better operating condition than
    “A” Battery,
    it
    would be an arbitrary and unreasonable hardship to deny the
    variance.
    For the above reasons, the Board grants the requested
    variance.
    This Opinion constitutes
    the findings of fact and conclu—

    law of the Board in this matter.
    ORDER
    It.
    is the Order of the Pollution Control Board that:
    1)
    The final date for shutdown of “A” Battery shall be
    February
    8,
    1979 and the final
    shutdown date of “B”
    Battery
    shall be June 11,
    1980.
    2)
    Granite City Steel
    shall notify the Agency in writing
    when
    “B” Battery
    is shut down.
    Notification
    shall
    he
    within seven
    (7)
    days subsequent
    to shutdown and shall
    he sent to:
    Illinois Environmental Protection Agency
    Division of Air Pollution Control
    Region III

    Within 45 days of the date of this Order, Granite City
    Steel
    shall execute and forward to the Illinois Environ-
    mental Protection Agency,
    2200 Churchill Road, Spring-
    field,
    illinois
    62706 a Certification of Acceptance and
    Agreement
    to be bound to all terms and conditions
    of this
    Order.
    The 45 day period shall be held in abeyance
    during any period this matter
    is being appealed.
    The form
    of said certification shall be as
    follows:
