ORDER OF THE BOARD
(by Mr. Young):
On June
17, 1976 Johnson Oil Company filed a petition for
variance with the Board.
The petition is inadequate
in that
it fails
to comply with the requirements of our Procedural
Rule
401.
It is the Order of the Board that Petitioner shall amend
its petition within 45 days of this Order.
Petitioner
is
directed to supply information, including, but not limited to
the following data:
the average dry weather flow of the treat-
ment plant; the designed dry weather flow of the treatment plant;
the maximum hydraulic capacity of the treatment plant;
the BOD
and suspended solids concentration of the effluent and of the
receiving stream; and the design and construction grant status of
Hanna City in regards
to the treatment plant improvements.
Failure to timely file an amended petition shall cause the
petition to be denied without prejudice
for inadequacy.
The 90-
day decision period set by Section 38 of the Environmental Pro—
tection Act shall run from the date of the filing of the amended
petition.
