filed a motion to dismiss
for inadequacy
or
in
the alternative
to compel
a specification of alleged error.
The
Agency claims that the petition for review of
the NPDES permit
filed by Warner Electric Brake
& Clutch Company
(“Warner”)
is not
specific enough and consequently, the factual and legal
issues
are not clear.
This motion
is denied.
The Agency may refile
this motion with the hearing officer
if
it so choses.
