the Board proposed to adopt a new rule,

The first notice
comment period expired on February
19, 1985.
The ~d~inistrative
Code Unit submitted a comment on January 24, 1985 concerning
Illinois Register first notice format.
On January
3,
1985,
Engineering Dynamics International of
St. Louis, Missouri
suggested adding
a subsection c to the proposed rule:
“wjhen
upgrading facility, replace worn out hammers with
those that produce
less sound”.
The engineer also suggested
that Clifford-Jacobs buy nearby land as an economical
buffer zone.
No other comments have been received.
In response to the comments by Engineering Dynamics
International, while the record does not show
if surrounding
land
is available for purchase by Clifford—Jacobs,
the
Board doubts that such action would be beneficial.

The Board declines to add a subsection c.
The idea
of
upgrading with less noisy equipment is already mentioned
on page three of the December 6,
1984 Opinion.

or even establish that
it currently exists.
If noise
levels become excessive,
citizens have the right to initinte
proceedings to change the rule.
