ORDER OF THE BOARD

Anderson):
In the process of codifying its Procedural
Rules, the
Board
determined that a certain amount of “up date” of existing rules
would be in order,
and that new rules should be drafted to
implement recent legislation,
including SB 172 and the Regulatory
Flexibility Act.
Initiation of this contemplated rulemaking
proceeding has been delayed pending receipt of sufficient printed
copies of the codified Procedural Rules to allow for meaningful
public participation in this revisory process.
As copies of the
codified rules are now available this docket is hereby opened.
The
Board
is
in
the
process
of
developing
a
draft
revision
for
public
comment
(and
hearing,
if
such
is
deemed
necessary).
As citizens groups,
environmental law practitioners, the organi~d
bar, and the Board’s Hearing Officers have already evinced
considerable interest
in an up date proceeding, the Board finds
it
appropriate to solicit input prior to issuance of a first
draft.
In the interest of expediting this proceeding, comments and draft
rules
received
by
December
6,
1982
will
he
considered
for
incorporation
into
the Board’s initial draft.
