On September 20,
1982 the Illinois State Chamber of Commerce
and the Illinois Manufacturers’ Association moved to stay further
hearings
in this rulemaking.
At the September 21,
1982 public
hearing the Board’s hearing officer denied said Motion and agreed
to refer
it to the Board.
On September 30,
1982 Granite City Steel filed comments
in
support of the Motion to Stay.
On October
1,
1982 Chicago Lung
Association
on behalf of Citizens for a Better Environment,
Illinois League of Women Voters,
American Association of Uriiver—
sity Women—Illinois State Division and Mc Henry County Defenders
filed
a Memorandum in Opposition to the Motion to
Stay.
On
October
4, 1982 the Agency responded in opposition to the Motion
to Stay.
This rulemaking was initiated by the Illinois Environmental
Protection Agency (Agency).
At this time,
the Agency has only
partially presented its proposal and the public participants
have only minimally commented on its merits or lack thereof.
To
assure that the Agency,
as the proponent, has sufficient oppor-
tunity
to substantiate the rules as proposed and any interested
participants ample opportunity to publicly offer input as
to
appropriate
rules, the merit hearings shall continue.
The
motion is denied.
