ORDER OF THE BOARD

On January
5,
1982, the
Metropolitan Sanitary
District
of Greater Chicago
(MSD)
filed a motion to cancel
a merit hearing
which has been set in this matter
for February
9,
1982.
The
MSD alleges that
“a
determination as to chlorination
must be
made before February 18,
1982 to enable the
taxpayers
of
the District to
save approximately $2,370,000” based
upon
contracts that the MSD
has entered into~
Under usual circumstances
such a motion
would be decided
by the hearing officer
with a right of appeal
to
the Board.
However, given the time
constraint,
the
hearing
officer has
referred the motion directly
to the Board.
That motion is hereby
denied.
The Board notes
that a considerable number
of comments
have been received by the Board concerning this proceeding
since the last hearing, that the First Notice proposal differs
substantively from the Agency proposal which was the basis for
earlier hearings,
and that the “Second National
Symposium
on Municipal Wastewater Disinfection’~will take place
January 26-28,
1982.
By holding another hearing, the
Board
will be in a better position to evaluate the
comments,
interested persons will have an opportunity to testify
concerning the Board~sproposal,
and the Board will have the
benefit of gathering any new information which may come out of
the national symposium.
The Board is well aware of the potential cost savings of
this proceeding and that any delay in final adoption may well
cause considerable expense to affected industries and public
bodies.
On the other hand,
greater costs may well arise from
an inadequately considered decision in this matter.
However,
the Board will make every reasonable attempt to expedite its
~1ecision.
