A number of comments on the adopted rules

have been filed, pursuant to the Board~srequest in the Prelim-

inary Opinion of September 16.

The Board hereby proposes to modify the September 16 rules

as is discussed in a proposed Opinion and as appears in a

modified, proposed text of

the

rules which will not appear in

the Opinion volume, but which will be made available to partici-

pants and any other persons requesting them.

The Board proposes

to modify the September 16 rules by amending them to correspond

with the proposed text.

The Board solicits additional comments

on the proposed ru1e~sand Opinion within

45 days of the date of

this Order,

The Board will make every effort to adopt any

needed changes prior to Phase

I authorization, including the

scheduling of an emergency meeting should this appear imminent.

The Board notes that USEPA has scheduled a December

hearing on the Agency~sPhase

I application.

The Board intends

that this draft should be available for use by persons attending

that hearing.
