    ORDER OF THE BOARD
    (by J.D. Dumelle):
    On September 25,
    1981 Citizens Against Hampton Township
    Landfill
    (Citizens) filed an amended complaint in PCB 81-112.
    Since PCB 81—112 had been previously dismissed in its entirety,
    that amended complaint was treated as a new case and docketed
    as PCB 81—155.
    On October 19,
    1981 Citizens filed a motion
    to consolidate the record in PCB 81-112 with PCB 81-155.
    The Board finds that the first six counts of the complaint
    in PCB 81—155 are identical to the complaint in PCB 81-112.
    Since the Board has previously decided that it did not have
    the power to consider the complaint in PCB 81-112, the Board
    accordingly dismisses Counts 1—VI of PCB 81—155.
    In addition,
    since the Illinois Environmental Protection Agency (Agency)
    is not alleged to have violated any Board rules or the Environ-
    mental Protection
    Act, except perhaps
    in its permitting capacity
    which the Board cannot consider, the Agency is hereby dismissed
    as
    a respondent in PCB 81—155.
    The motion to consolidate is granted to the extent that
    the record in PCB 81—112 is hereby incorporated into the record
    in PCB 81—155.
    IT IS SO ORDERED.
