    ORDER OF THE BOARD
    (by D. Anderson):
    On October 16, 1981 Quality Ready Mixed Concrete Products
    filed a petition for extension of a variance to burn in an air
    curtain destructor lumber removed from scrapped railroad cars
    (PUB
    76-224,
    24 PCB 261, November 10, 1976).
    The Board notes
    that it has recently granted a similar variance to the City of
    Freeport
    (PCB 81-57, September 3,
    1981).
    A motion to dismiss
    was filed on October 22,
    1981.
    The petition is deficient in a number of respects, including
    failure to supply information required by Procedural Rules
    401(a),
    401(c)
    and 401(d).
    Petitioner has waived its right to a hearing
    but has not included an affidavit as required by Procedural
    Rule 401(b).
    The petition will be subject to dismissal unless
    an amended petition addressing the noted deficiencies is
    filed
    within 45 days of the date of this Order.
    The decision period
    will commence with the filing of such amendment.
    The motion to
    dismiss is denied.
