On March 30,
1981, eleven Des Plaines citizens filed a complaint
in the above matter, each of which were docketed PCB 81-71 through
PCB 81—81.
On April
14,
1981 the Board received proof of service
of all these formal citizen complaints
from the City of Des Plaines’
environmental officer.
For reasons of adjudicial economy,
and because all complaints
allege violations of identical Board rules and contain common issues
of fact, all but one of which therefore being duplicitous,
the
Board dismisses all claims but one.
Although normally the Board would find all matters filed
after the first to be duplicitous,
the Board finds, pursuant to
information by the Des Plaines officer, that the proceeding PCB
81—76,
Mr. Kraus’
complaint,
is best prepared of all eleven to
go forth at this time.
The Board therefore dockets consolidated
proceedings under the styling “PCB 81—76”
(KRAUS v. MSD),
during
which
all Complainants
in PCB 81-71 through PCB 81-81 will he
allowed to participate.
