ORDER OF THE BOARD

On September 29,
1980 the Village of Buffalo Grove filed a
petition foz
a variance from Rule 304(C) (1)
of Chapter 6:
Public
Water Supplies.
This sets maximum allowable concentrations of
Ra -226 and -228 and gross alpha particle activity.
The petition
contains a waiver of hearing but no affidavit or other proof re-
quired by Procedural Rule 401(b).
In addition,
the Environmental
Protection Agency has indicated that there is an error in its
analytical methods resulting in overestimation of radioactivity
levels
(Minonk v.
EPA, PCB 80-136).
The Agency is no longer re-
fusing to issue water main extension permits for supplies unable
to demonstrate compliance with radiological standards.
Since the
data are defective and the hardship no longer exists, it is unlikely
that Buffalo Grove will be able to show that it is entitled to a
variance.
The petition is dismissed without prejudice.
