This variance petition filed August 15, 1980 is

inadequate

under Procedural Rule 401(b).

If hearing is waived,

then the

Petitioner must aver that the facts stated herein

(and,

since

requesting incorporation of the entire record in its earlier

petition,

PCB 79—171, the facts stated therein) are still

true.

The petition is further inadequate because the Board cannot

grant the relief requested without Rossmoor joining the County of

DuPage as a party Petitioner hereto.

If these inadequacies are not corrected within 15 days of

the date of this Order, the petition

is subject to dismissal.
