    CONCURRING OPINION

    While
    I agree that the variance,
    if needed,
    should be
    granted in this case I am bothered by the lack of data in
    this and other drinking water cases
    where radium content
    is
    the issue.
    Only a single sample
    is presented to the Board for its
    consideration from Well No.7.
    Rule 309(C)(1)
    is explicit
    in requiring either an annual composite of four consecutive
    quarterly samples or the average of the analyses of four samples
    obtained at quarterly intervals
    (Chapter 6).
    Since only a single sample has been taken
    from Well No.7
    the existence of a violation of Rule 304(C) (1) has obviously
    not been proven.
    Wells Nos.
    3,5, and
    6 are
    in the same 1350—
    1370 ft. depth as Well No.7
    (1350 ft.) hut are below the standard
    (15 pCi/i).
    It seems reasonable to question the reliability
    of the single sample from Well No.7.
    Thus on two grounds;
    the unreliability of a single sample
    from
    a well whose depth is essentially the same as three other
    conforming wells;
    and the failure to meet the four sample
    requirement of Rule 309(C) (1),
    it seems to me that the need
    for the variance has not been shown.
