ORDER OF THE BOARD
(by Dr. Satchell):
On November 26 and December 20,
1979 Central Illinois
Public Service Company
(CIPS)
filed motions to stay conditions
of NPDES permits for its Neredosia power station.
Condition
003A of Attachment B3A, involving boiler chemical cleaning
wastes,
is stayed for the reasons given in the Board!s Order
of this date in PCB 79—246 and 247.
The other conditions for
which stay is requested involve total suspended solids
(TSS)
in
cooling water discharges.
CIPS contends that the permit con-
ditions would require it to reduce TSS to below background levels
and that it falls under the proviso of Rule 401(b)
of Chapter
3:
Water Pollution.
This
is a renewed permit and the condition is
apparently new although a similar permit condition relating to
ash ponds was rejected by the Board in a previous permit appeal
involving this facility

1975).
The Environmental Protection Agency
(Agency)
filed
responses
to the motions on December
12 and 24,
1979.
The Agency
does not contend that these TSS conditions are mandated by new
regulations4
Apparently the Agency
is exercising discretion with
respect to the interpretation of the background concentration.
Since these are new discretionary conditions
they will be stayed.
The motion is granted.
