OF
THE
BOARD
(by Mr. Goodman):
On September
8,
1978, Olin Corp.
filed a permit denial
appeal.
In its petition,
Olin appeals the denial by the
Environmental Protection Agency of its application for
operating permits for its tripolyphosphate dryer kilns.
Olin also requests a ruling from the Board relative to the
permit status of its phosphoric acid plant under Rule 203,
even though the air permits for this plant are not scheduled
to expire until August 11,
1979..
The Board orders that Olin
s appeal from the denial of
its permit application for its tripolyphosphate kilns be set
for hearing.
However,
the Board finds that the permit status
of Olin’s phosphoric acid plant is not ripe for adjudication.
Any determination of such status would at this point be an
advisory opinion, and the Board does not issue advisory opinions.
Olin’s request for a ruling from the Board relative to the permit
status of its phosphoric acid plant is therefore dismissed.
Finally, Olin requests that the data and information
contained in Appendix C of its Statement of Position be kept
confidential because it
constitutes trade secrets.
The Board
hereby orders that such data and information be stamped “Not
Subject to Disclosure.”
