ORDER
OF THE
BOARD
(by Mr. Dumelle):
On September 13,
1978 Petitioner requested a variance
from the Board’s Air Pollution Control Regulations as they
pertain to grain loading operations.
The Petition is insuf-
ficient in several respects.
First,
it fails
to assess the
environmental impact of the requested relief as required by
Procedural Rule 401(a) (7).
Second,
it fails to describe a
control program which will result in compliance with the
Board’s standards by July 1,
1979 as required by Section 113
of the Clean Air Act; or, in the alternative, the need for a
revision to the State Implementation Plan under Section 110
of the Clean Air Act in the event relief
is needed beyond
July 1,
1979.
Third,
it fails to specifically request or waive
a hearing as required by Procedural Rule 401(b).
Consequently,
this matter
is hereby dismissed without prejudice.
IT IS SO
ORDERED.
