(by Mr. Young):
I filed a Dissenting Opinion
in
R74~1O,
the Motor
Vehicle Noise Regulations proceedings adopted by the
Board on May 26,
1977, because
I found no authority in
the
Act for the promulgation of equipment standards
such as enacted in Rules
301,
302 and
313(b)
of Chapter
8.
The
Motor
Racing Noise Regulations adopted on
May 11,
1978,
are,
in part, deficient for the
reasons
set forth
in my dissent in R74~l0,
I believe that
adequate noise emission reduction from motor racing
facilities can and should be accomplished within the
authority of Section 25 of the Act.
It is my further
opinion that reasonable numerical property line noise
limitations can be established for such facilities and
that methods of compliance are best left to the motor
racing operators and participants.
This conclusion is,
of course,
at odds with the majority position expressed
on pages
6 and
7 of the Opinion.
