AND
ORDER
OF
THE
BOARD

On March
31,
1977,
the Village of Graysiake, Lake County,
Illinois,
submitted a Petition
for
Variance before the Board.
The
Village seeks variance from Rule 962 of
the
Water
Regulations,
Chapter
3 of the Board’s Rules and Regulations,
in
order to obtain a permit
for sewer connections to the Gravslake Sewage Treatment Plant, which
is currently under restricted
status because the Environmental Protec-
tion Agency
(Agency) has determined that
it is hydraulically and bio-
logically overloaded.
The Agency filed
its Recommendation
in this
matter
on
April
25,
1977.
No hearing has been held.
The
Village
seeks
to
construct
a
sanitary
sewer
extension
to
serve
eighteen
single
dwelling
residential
units
and
six
non—residential
buildings
in
the
~~Triangiei
area
bounded
by
Route
83,
Route
120
and
Ivanhoe
Road.
The
estimated
average
flow
for
this
project
area
is
9800
qalions
per
day,
and
the
estimated
maximum
flow
for
this
project
area
is
39,200
gallons
per
day.
The
effluent
generated
would
be
primarily
domestic
wastes.
The
Village
indicates
that
the
antici-
pated
daily
load
would

he operational by May,
1977.
The Village alleges that the septic systems presently serving
the subject area are inadequate and constitute
a health hazard.
The
Agency agrees.
Petitioner indicates that several septic systems
in
the
area
have
failed.
Samples
taken
from
a
storm
drain
that
crosses
Route
120
between Invanhoe
Road
and
Route
83
indicate
that some of

the percolation tile fields are not working properly and that direct
discharges to the surface runoff collection system are occuring.
Furthermore, due to the seasonal high water, additional land would
be required for adequate septic system performance,
and that land is
not available.
The Village indicates that, during periods of hydraulic over-
loading of its sewage treatment plant,
some flow bypasses the primary
and secondary operations and enters a lagoon which is aerated and the
outflow chlorinated.
Thus,
all flows receive primary treatment
(some
settling)
and chlorination.
The Village indicates that sewer
connections to serve the Triangle area would at least reduce the coli—
form bacteria currently discharging from the area.
Ultimately,
the
Grayslake Sewage Treatment Plant will be phased out and the sewage
from Grayslake ‘~treatedat the North Shore Sanitary District Plant
in
Gurnee, Illinois.
The present anticipated completion date for the
Gurnee Plant is sometime during the fall of 1977.
The Board finds that an arbitrary and unreasonable hardship
would result from the denial of this variance.
Although the Graysl~ke
plant is on restricted status,
a variance to allow sewer connections
to this system is justified in order to eliminate inadequate septic
systems which pose an even greater health hazard
to
the public.
There-
fore,
subject to the conditions listed below, the Board will grant the
Village a variance from Rule
962 of Chapter
3 to allow the Village to
obtain sewer connection permits for the units listed in its Petition.
This Opinion constitutes the findings of fact and the conclusions
of law of the Board in this matter.
ORDER
It is the Order of the Pollution Control Board that the Village
of Grayslake be granted
a variance from Rule 962, Standards
for
Issuance,
of Chapter
3:
Water Pollution Regulations,
subject
to
the following conditions:
1.
That the Village apply for and obtain
a construction
and operating permit for the subject sanitary sewer ex-
tension;

2.
That
the
Village direct all sanitary flow to the
Gurnee sewage treatment plant within thirty days after
the interceptor to said Gurnee plant becomes available;
3.
That the variance granted herein shall be limited
to
the
eighteen
existing
residential
units
and
six
existing non—residential
units set forth
in the
variance
petition;
and
4.
That within 28 days of the Board Order herein the
Petitioner shall forward to the Illinois Environmental
Protection
Agency,
Variance
Section,
Manager,
Division
of
Water
Pollution
Control,
2200
Churchill
Road,
Springfield,
Illinois 62706, and to the Illinois
Pollution
‘Control
Board
a
Certificate
of Acceptance and
Agreement
to
be
bound
by
all
terms
and
conditions
of
the
variance.
The form of said Certification shall be
as
follows:
