ORDER OF THE BOARD

On May
4,
1977, the Air Transport Association of America
(ATA)
filed a Motion for Leave
to Appear for a Postponement of Hearings
Herein, and fo~a Deferral of Briefing or Consideration of Constitu-
tional ,and Statutory Questions Relating
to the Proposed Regulations.
The Motion for Leave to Appear
is hereby granted.
However, the Board
finds that delay of the hearings is not warranted, and denies the
Motion for Postponement.
Furthermore, although the Board has not
required any briefing of constitutional and statutory questions, we~
find it inappropriate to bind ourselves
to a particular time for
deciding those issues should they arise.
The Motion for Deferral of
Briefing and Consideration of Constitutional and Statutory Questions
is denied.
Mr. Zeitlin and Mr. Young dissented.
