203(i) (5) Decision is hereby denied.
In an Order herein dated
July
8,
1976 the Board granted Union Electric Company variance
from the five-year delay prior to hearing required by Rule
203(i) (5)
.
The Board thus accepted the studies
submitted to
the Environmental Protection Agency
in January of 1976
as
Petitioner’s submission under Rule 203(1) (5).
There was at the
time of the variance herein no regulations promulgated for the
conduct of the mandatory hearing required under Rule 203(1) (5).
Such regulations have now been promulgated,
and the Board hereby
Orders that hearing be set
in this matter under Part VI
of the
Board’s Procedural Rules and said hearing shall be conducted
consistent with the variance granted on July
8,
1976.
Rule
604 of Part VI of the Board’s Procedural Rules
is hereby waived
in this matter.
