ORDER OF THE BOARD
(by Mr. Goodman):
On February 10, 1977 Interlake,
Inc., submitted a Counterclaim
for Variance in PCB 76-310.
For the Board’s convenience,
this
matter was accepted as a Petition for Variance and given the number
PCB 77-44.
On February 17,
1977 the Board ordered Interlake to
amend their petition for variance within 35 days.
On that same day,
Complainants moved to Dismiss the Amended Counterclaim for Variance,
objecting
to its form and contents.
Finding that the Board Order of
February 17,
1977 substantially addresses the subject matter of the
Complainants Motion to Dismiss,
the Board hereby denies the Motion.
