ORDER OF THE BOARD

On September 2,
1982 the Board ordered,
for reasons there
stated, that hearing
in this action be scheduled within 15
and
held within 45 days of the date of that Order, or the action
would be dismissed.
On September
13, hearing
in this matter
was scheduled for October
7, which hearing was continued until
an uncertain date on October
7.
On October 12,
1982,
in a “joint motion for stay and
dismissal”
the parties stated that hearing was not held “because
the parties were able to resolve the issues raised herein”.
The
Board is requested to stay this action until
a proposed draft
permit which the Agency “agreed to issue”
at some unspecified
time becomes final at some unspecified
future
date.
The
Board declines to grant the motion to stay this
3 year
old action for an indefinite period.
The Village is ordered to
file a report on the status of the proposed draft permit within
45 days of the date of this Order.
