the Agency filed
a Motion to
Dismiss
or Order Additional
Information.
The Board
finds
that significant issues raised
in
the
Acency’s
Motion are not answered in the Petition.
Petitioner
shall respond
fully
to those issues within
30 days of the date of this Order,
which response may take the form of an Amended Petition or other
appropriate pleading.
Failure
to so respond may be cause
for
dismissal
of the Petition without prejudice.
The 90-day decision
period set by statute shall
run from the date of filing such Amended
Petition.
