ENVIRONMENTAL PROTECTION AGENCY,
Respondent.
INTERIM ORDER OF THE BOARD
(by Mr.
Zeitlin):
The instant proceeding was filed on January
26,
1977,
by
the
City
of Rochelle, apparently as
a Permit Appeal.
It
is not clear,
however,
exactly how the Board
is to grant
the requested relief,
or exactly what decision
by
the Environmental Protection Ajency
is
being appealed.
The Board must be furnished with
a copy of the Agency’s “permit
modification denial,~ which is apparently the subject of Rochelle’s
Petition.
The Board must also be furnished with all information
required by Part V of the Procedural Rules with regard to Permit
Appeal Petitions.
Without such information,
the Petition is
inadequate.
It
is the Order of the Board that Petitioner amend its Petition
within forty-five
(45)
days of the date of this Order
to provide the
required information.
Failure to timely file the Amended Petition
will result in dismissal of the Petition for inadequacy, without
prejudice.
The
90—day
decision period set
by statute
shall
