    The Petition for Variance

    The Petition, as amended,
    is deficient
    in the following re-
    spects:

    The Petition fails to indicate those specific Regulations
    from which Variance
    is sought;
    2)
    The precise or approximated amounts by which discharge
    limitations will be exceeded
    is not shown,
    (one day’s historical
    data
    in Exhibit
    I
    being insufficient);
    3)
    The period for which Variance is sought, with regard to
    both Regulations affected by a proposed set of interim control
    measures and those covered by Petitioner’s
    “Phase
    I”
    final com-
    pliance sLudy,
    is
    not shown;
    4)
    The expected results of Petitioner’s proposed interim
    measures are not shown.
    5)
    The Petition fails
    to detail the effects
    (if any)
    on the
    environment of continued operations under the Variance.
    For guidance,
    Petitioner
    is referred to Rule 401 of the
    Board’s Procedural Rules.

    It
    is the Order of the Board that Petitioner shall amend
    its
    Petition within
    45 days of this Order to provide the above information
    and achieve compliance with Procedural Rule
    401.
    Failure to timely file
    the Amended Petition shall cause the Petition
    to be dismissed without
    prejudice for inadequacy.
    The 90-day period for decision set by
    Statute shall run from the date of filing the Amended Petition.
