to Dismiss, alleging that the

case is mooted by virtue of City of Joliet v.

EPA, PCB 76-174

1976), and that the permit whose issuance

is the

essence of Petitioner’s requested relief may now be issued

without Variance pursuant to the Joliet decision.

We agree,

on the pleadings before us.

The case

is dismissed

without prejudice.
