INTERIM ORDER OF THE BOARD
(by J.D.
Dumelle):
The City of Cairo filed a letter on September
5,
1980 which
the Board construes as a Petition for Variance Extension. As
such,
it must be amended to conform with the requirements of
Procedural Rule 401(a).
The present Petition is deficient in the
fóllowing respects:
1.
The precise extent of the relief sought,
including the
particular provisions of the regulations from which
variance is sought and the length of time for which
variance is requested (401(a) (1)).
2.
Data describing the present failure to meet standards
(401(a)(5));
and
3.
A schedule for completion of the control program
(401(a) (6)).
The Board notes that some,
or all, of these deficiencies may
be cured by an incorporation of the record in the earlier
variance proceeding
(PCB 77—256).
If that is done,
however,
a
statement of the continuing validity of the allegations in that
proceeding and any changes therein must accompany the petition
and be sworn to.
If, within 45 days of the date of this Order,
the City does
not file an amended Petition containing the above information,
this Petition may be subject to dismissal.
IT IS SO ORDERED.
