PROPOSED CALIFORNIA MOTOR VEHICLE CONTROL
PROGRAM DISMISSED, R89-17(C)
On January 7, 1993, the Board dismissed the proposed
California motor vehicle control program docket. The Board had
opened this docket on October 18, 1989 to consider adoption of
the California standards applicable to motor vehicle emissions.
The federal Clean Air Act only allows states to adopt the federal
new vehicle standards or the more stringent standards of the
State of California. The proposed rule would have required that
all new motor vehicles adhere to those standards.
The Board held public hearings on various versions of the
basic proposal to adopt the California standards on December
12, 1989, July 23, 1991, and July 22, 1992 and received 60
public comments. The Board proposed its initial version of a rule
in this matter on April 12, 1990, and dismissed that initial version
(dockets A and B) on February 7, 1991. The Board proposed a
subsequent version (docket C) on October 11, 1990. That later
version focused on the relatively new California Low Emission
Vehicle (LEV) program.
In dismissing this rulemaking, the Board followed the general
tenor of the public comments and public testimony at the
hearings. The Board noted that numerous comments in the
record cited significant economic and environmental uncertainties
involved in Board adoption of the California standards for Illinois,
rendering the benefits of doing so uncertain. The Board
concurred in the Agency comment that dismissal of this
proceeding at this time did not foreclose a future adoption of the
California standards, if necessary, after the state has determined
the emissions reductions to be gained through implementing the
federal requirements of the Clean Air Act Amendments of 1990.

FERTILIZER AND PESTICIDE FACILITIES EXEMPTED FROM
GROUNDWATER PROTECTION REGULATIONS, R92-20
On January 21, 1993, the Board adopted amendments that will
exempt agricultural fertilizer and pesticide facilities from the
groundwater protection regulations of 35 Ill. Adm. Code 615 and
616. The facilities exempted include those located within
maximum setback zones that store or engage in related handling
of these materials for commercial application or for distribution to
retail sales outlets. The amendments are in response to P.A. 87-
1108, signed by the Governor on September 15, 1992. For the
exemption to apply to a facility, the facility owner or operator
must have filed a notice of intent to be subjected to Section 14.6
of the Act, as added by that bill, by January 1, 1993, or the
facility must file this notice within six months of when a maximum
setback zone is established. Address questions to Michelle

RCRA UPDATE ADOPTED, R92-10
On January 21, 1993, the Board adopted amendments to the
RCRA rules. These amendments correspond with USEPA
amendments for the period from January 1, 1992 through June
30, 1992. Among the amendments included in this period are
the leak detection rules for land disposal units (landfills, surface
impoundments, and waste piles), provisions for adjusted
standards for alternative design and operating practices for
permitted land disposal units, and an extension of the stay for the
drip pad requirements for wood preservers (wood preserving
rules) until the Board takes final action in docket R93-4 (the next
RCRA update docket, for the period from July 1 through
December 31, 1992. The Board expressly did not adopt a sunset
provision for the mixture and derived-from rules in this docket.

reserved docket for updates to the exemptions from the definition
of volatile organic material. The update period spanned from
July 1 through December 31, 1992. During that period, USEPA

INDIVIDUAL WASTE GENERATORS MUST
OBTAIN ยง39(h) AUTHORIZATIONS FOR
DISPOSAL; ENFORCEMENT ACTION AGAINST
THE AGENCY IS NOT AUTHORIZED BY THE
ACT
An Illinois Appellate Court recently reversed the
Board's dismissal of a citizen's land enforcement
complaint in Envirite Corp. v. Pollution Control Board
(3d Dist. Jan. 8, 1993), No. 3-92-0202. The appellate
court's decision interpreted Section 39(h) of the
Environmental Protection Act to determine that the Board
erred when it granted summary judgment and dismissed
the complaint.
In Envirite Corp. v. Peoria Disposal Corp. (Dec. 19,
1991), PCB 91-152, the complaint alleged that the
respondent, Peoria Disposal Co. (PDC), violated the
Environmental Protection Act because it disposed of
hazardous wastes in its landfill without the generator of
the wastes having first obtained authorization from the
Agency for landfill disposal. Section 39(h) of the Act
requires that the generator of hazardous waste and
disposal site owner must obtain authorization from the
Agency for the deposit of that specific hazardous waste
stream. The complaint also named the Agency as a
respondent, alleging that the Agency was guilty of
administrative nonfeasance because it had failed to abate
the PDC practice of accepting the waste without the
authorizations for the individual generator's waste
stream.
In granting summary judgment, the Board had held that

PDC was the generator of the wastes for the purposes of
the Act because PDC mixed and treated the wastes from
various generators prior to disposal, so PDC was the
generator for the purposes of Section 39(h), not the
generator from whom PDC received the unblended,
untreated wastes. PDC had the necessary Agency
authorization for this blended and treated wastestream.
The Board further dismissed as to the Agency because it
held that the Act nowhere authorizes the Board to direct
the Agency's conduct.
In reversing the Board, the court looked to the
legislative intent and held, as to the dismissal of the
complaint against PDC, that the original industrial
producer of a hazardous waste is a "generator" for the
purposes of Section 39(h), even where the disposal site
owner and operator treated the waste prior to disposal.
Hence, according to the court, the original producer of
the waste is required to obtain Section 39(h) authorization
for disposal from the IEPA. As to the complaint against
the Agency, the court upheld the Board's ruling that the
IEPA is not subject to an enforcement action before the
Board. The court held that "the Act does not authorize
an action against the Agency before the Board to
challenge the Agency's performance of its statutory
duties in issuing [Section 39(h)] authorization[s]." The
court further upheld the Board's exercise of its discretion
in the denial of the filing of a reply brief as "neither
arbitrary nor capricious". The court remanded the matter
for reinstatement of the complaint against PDC and
further proceedings before the Board.

PUBLIC HEARING ON AMENDMENTS TO
LANDFILL REGULATIONS, R92-19
The Board has scheduled public hearings on its own
rulemaking proposal to amend the landfill regulations in
response to a judicial decision that held certain provisions
invalid. The hearings are scheduled for February 26, in
Chicago, and March 16, in Springfield. The will require
the submission of pre-filed testimony and exhibits.
In Waste Management of Illinois, Inc. v. IPCB (1st
Dist. 1992), 231 Ill.App.3d 278, 595 N.E.2d 1171 (
see
Environmental Register
No. 458, October 15, 1992), the
court held that the Board failed to follow the procedures
set out in section 27(b) of the Environmental Protection
Act when enacting 35 Ill. Adm. Code 811.310(d)(1)(F).
Therefore, the court found section 811.310(d)(1)(F)
invalid. The court also invalidated section 35 Ill. Adm.
Code 813.106(b), finding that the Board exceeded its
statutory authority in promulgating a regulation which
would have delayed the finality of an Agency decision
pending reconsideration. The proposed rulemaking
would amend the Board's landfill regulations by deleting
those provisions found invalid in Waste Management.
The Board is also accepting comment as to whether a
third provision, 35 Ill. Adm. Code 811.310(c)(5), should
be deleted because it references 35 Ill. Adm. Code
811.310(d)(1)(F).

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies which are in violation of 35
Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a violation of any of
the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604, Subparts B and C; maintenance of
adequate pressure on all parts of the distribution system under all conditions of demand; meeting raw water quantity requirements of
35 Ill. Adm. Code 604.502; or maintenance of treatment facilities capable of providing water "assuredly adequate in quantity" as
required by Section 18 of the Illinois Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for certain limited
situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board for the violation, or from permit
issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any
public water supply should be directed to the Division of Public Water Supplies for final determination. This list reflects the status as of
January 1, 1993.

Critical Review List -- Public Water Supplies

The Critical Review List was developed to give additional notification to officials of public water supplies which may be close to being
in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the violations which
would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the status of any
public water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of January 1, 1993.
Indicates public water supplies which have been added to the list since the previous publication.
Indicates actions are being taken by officials to bring the public water supply into compliance.
