ORDER OF THE BOARD

On June 4,
1982 the Illinois Environmental Protection
Agency
(Agency) filed a Motion for Ordc~rwhich requested that
the Petitioner provide information identifying the original
permittee and the present holder of the permit which Petitioner
is seeking to extend by this variance proceeding.
The Agency
also requested that Petitioner address the legal authority for
and transfer of this permit.
An addendum correctly identifying
the exhibits attached to the motion was filed by the Agency on
June 9,
1982.
No response by the Petitioners has been filed.
Since filing this motion, the Agency has served Petitioner
with Interrogatories and Request for Admission of Facts which
address the identity of the permittee in this proceeding.
Thus
normal discovery methods will provide the information requested
by the Agency.
As for the legal issues involved in a possible
transfer of the permit,
the parties are free to address these
in briefs submitted to the Board prior to its final decision.
The motion
is denied.
