On August 19, 2004, at the parties’ request, the Board extended until November 3, 2004,
the time period for Premcor Refining Group, Inc. (Premcor Refining Group) to appeal a June 30,
2004 determination of the Illinois Environmental Protection Agency (Agency).

5/40(a)(1) (2002); 35 Ill. Adm. Code 101.300(b), 105.402, 105.406. The Agency rejected
petitioner’s high priority corrective action plan for Premcor Refining Group’s leaking
underground petroleum storage tank facility located at 600 South Main Street, in Morton,
Tazewell County. Because petitioner failed to timely file an appeal, the Board dismisses this
case and closes the docket.
